Public Offer Agreement
for the provision of services for a fee (Public Offer) — edition of July 17, 2026
This text constitutes a public offer by ООО МАКА Арт (UNP 193923833), hereinafter referred to as the “Contractor”, to enter into a contract for the provision of services for a fee on the terms set out below with any natural person, hereinafter referred to as the “Customer”, who accepts this offer. Legal entities and sole traders enter into a separate written contract with the Contractor.
1. General provisions
- 1.1. This Agreement is a public contract (public offer) within the meaning of Article 396 of the Civil Code of the Republic of Belarus.
- 1.2. Full and unconditional acceptance of the terms of this Agreement occurs when the Customer books the services (makes a reservation) and/or pays for them in full or in part (makes a prepayment) in the manner set out in this Agreement (paragraph 3 of Article 408 of the Civil Code of the Republic of Belarus).
- 1.3. The Agreement is deemed concluded in simple written form from the moment of acceptance and does not require any additional signature on paper.
- 1.4. The Contractor may amend the terms of this Agreement by publishing a new edition on the maka.by website with its date indicated. The edition in force at the moment of acceptance applies to the relations between the parties. The current edition is dated July 17, 2026 (version 2.0).
- 1.5. By accepting, the Customer confirms that they have read this Agreement, the Cancellation and Refund Policy and the Personal Data Processing Policy, and agree to them.
2. Subject matter of the Agreement
- 2.1. The Contractor undertakes to provide the Customer with services for organising and conducting creative workshops and other leisure events (hereinafter the “Services”), and the Customer undertakes to accept and pay for these Services. The Services are of a leisure (entertainment) nature and do not constitute the delivery of educational programmes.
- 2.2. The name, programme, duration, venue and price of specific Services are indicated on the Contractor’s Website, on social media or directly in the studio.
- 2.3. The Contractor may engage third parties to provide the Services without the Customer’s additional consent, while remaining responsible for the provision of the Services.
3. Booking procedure and provision of services
- 3.1. The Services are provided by prior appointment on a date and at a time agreed by the Parties; the session is held privately for the Customer or the Customer’s party. To receive a Service, the Customer makes a prior reservation (booking) on the Website, by telephone or via messaging apps.
- 3.2. A booking is deemed confirmed from the moment the prepayment is received (clause 4.2). Until the prepayment is received, the Contractor does not guarantee the studio reservation.
- 3.3. The materials and tools required for the workshop are provided by the Contractor and included in the price unless otherwise stated in the description of the Service.
- 3.4. The Customer must observe the studio rules of conduct and the safety rules, which the Contractor communicates to the Customer before the event begins (a briefing and/or information materials in the studio), treat the Contractor’s property with care, and follow the instructions of the artist when working with materials and tools.
- 3.5. Minors are admitted to events when accompanied by a legal representative or with the representative’s consent. Certain techniques (including work with hot wax) may be subject to age restrictions stated in the description of the Service; the legal representative is responsible for compliance with such restrictions.
- 3.6. A Customer who arrives late for the event is admitted from the moment of arrival; the duration of the Service is not extended in this case.
4. Price and payment terms
- 4.1. The price of the Services is set by the Contractor and published on the Website. Prices are stated in Belarusian roubles.
- 4.2. The Services are paid for on the basis of 100% prepayment or a partial prepayment (deposit), with the balance payable no later than the day the Service is provided. The amount of the prepayment is indicated at the time of booking.
- 4.3. Payments are made exclusively by non-cash means: by bank payment card on the Website or via a payment link sent to the Customer (online acquiring). The Contractor does not accept cash.
- 4.4. The document confirming payment (card receipt / payment confirmation) is sent to the Customer electronically. By accepting this Agreement, the Customer consents to receiving payment documents in electronic form.
5. Cancellation, rescheduling and refunds
- 5.1. The Customer may withdraw from the Service unilaterally at any time, provided that the Customer reimburses the Contractor for the expenses actually incurred in connection with the performance of its obligations under the Agreement (Article 736 of the Civil Code of the Republic of Belarus, Article 38-1 of the Law of the Republic of Belarus “On Consumer Protection”). The procedure for cancellation, rescheduling and refunds is set out in the Cancellation and Refund Policy, which forms an integral part of this Agreement.
- 5.2. The Contractor may reschedule or cancel a workshop (illness of the artist, force majeure) by notifying the Customer. In this case, at the Customer’s option, either a full refund of the amount paid is made or the booking is moved to another date.
6. Acceptance of services
- 6.1. The Service is deemed duly provided and accepted by the Customer if, within 3 (three) calendar days of the date of the event, the Customer has not sent the Contractor a reasoned complaint (clause 10.1).
- 6.2. The Parties have agreed that the primary accounting document confirming the provision of the Service (the certificate of completion) is drawn up by the Contractor unilaterally in accordance with Resolution No. 13 of the Ministry of Finance of the Republic of Belarus dated 12 February 2018. The Customer is not required to sign the certificate.
7. Liability of the parties
- 7.1. For non-performance or improper performance of obligations under this Agreement, the parties are liable in accordance with the legislation of the Republic of Belarus.
- 7.2. The Contractor ensures safe conditions for events: serviceable tools and equipment, a safety briefing, and compliance of the materials used with the applicable requirements.
- 7.3. The Customer must observe the safety rules and the instructions of the artist. Compensation for harm caused to life, health or property is determined in accordance with the legislation of the Republic of Belarus, taking into account the degree of fault of each party.
- 7.4. The result of a creative workshop depends, among other things, on the actions of the Customer. The Contractor is not liable for any discrepancy between the work created by the Customer and the Customer’s subjective expectations where the Service has been duly provided.
- 7.5. The Customer compensates for damage caused to the Contractor’s property intentionally or through gross negligence, in accordance with the legislation.
8. Photography and video recording
- 8.1. Photography and video recording of events, as well as CCTV surveillance for security purposes, may take place in the studio; Customers are informed of this in accordance with the Personal Data Processing Policy.
- 8.2. The Contractor publishes photo and video materials featuring the Customer for marketing purposes (website, social media) only with the Customer’s consent. The Customer may withdraw consent at any time and demand the removal of published materials featuring their image.
9. Force majeure
9.1. The parties are released from liability for non-performance of obligations caused by force majeure, as confirmed in the manner prescribed by legislation. The party affected by such circumstances notifies the other party within a reasonable time. If the Service cannot be provided due to such circumstances, clause 5.2 of this Agreement applies.
10. Complaints and dispute resolution
- 10.1. Complaints are sent to the Contractor by email (stated in section 11) or by telephone. Refund requests are considered within 7 (seven) calendar days of receipt; other requests within 15 (fifteen) calendar days.
- 10.2. Disputes not resolved through the complaints procedure are settled in accordance with the legislation of the Republic of Belarus.
